These Terms of Service (the “Agreement”) govern your access to and use of the Bakiyem mobile application (iOS and Android), the website at bakiyem.net and related services (together, the “Service”), operated by Bakiyem (“Bakiyem”, “we”, “us”). By creating an account or using the Service you accept this Agreement.
1. The Service
Bakiyem is a cloud-based accounting and automation software (SaaS) designed for jewelers, goldsmith workshops and similar businesses. It provides modules such as customer/contact ledger, stock and product management, receipts, POS, reporting and workshop tracking. The Service is provided “as is” on a subscription basis.
2. Account
- You must provide accurate, current and complete information when registering and keep it up to date.
- You are responsible for safeguarding your password and for all activity under your account.
- You must notify us immediately at info@bakiyem.net if you suspect unauthorized use of your account.
- The Service is intended for businesses; you must be at least 18 years old to use it.
3. Plans, Fees and Payment
- The Service is offered with a free trial plan and paid subscription plans (monthly or yearly). Current plans and prices are published on our pricing page.
- Card payments are processed securely by our payment provider iyzico; we do not store your full card details. Bank transfer (havale/EFT) is also available.
- Prices may change; changes apply from the next billing period and are announced through the Service.
- Cancellation and refund terms are described in our Cancellation & Refund Policy and the Distance Sales Agreement.
4. Your Content
All business data you enter into the Service (customers, balances, stock, receipts, reports) belongs to you. You grant us only the rights necessary to host, process, back up and display this data in order to provide the Service. We process personal data in accordance with our Privacy Policy.
5. Acceptable Use
You agree not to:
- use the Service for unlawful purposes or in violation of applicable law;
- attempt to gain unauthorized access to the Service, other accounts or our infrastructure;
- reverse engineer, copy, resell or sublicense the Service without written permission;
- transmit malware or content that infringes third-party rights;
- use the Service in a way that disrupts or overloads our systems.
6. Intellectual Property
The Service, including its software, design, logos and content (excluding your data), is owned by Bakiyem and protected by intellectual property laws. This Agreement grants you a limited, non-exclusive, non-transferable license to use the Service during your subscription.
7. Availability and Support
We aim to keep the Service available at all times but do not guarantee uninterrupted or error-free operation. Planned maintenance is announced where possible. Support is provided via the in-app/website support system and destek@bakiyem.net.
8. Limitation of Liability
To the maximum extent permitted by law, Bakiyem shall not be liable for indirect, incidental or consequential damages, loss of profit or loss of data arising from the use or inability to use the Service. Our total liability is limited to the fees you paid for the Service in the 12 months preceding the event. You are responsible for the accuracy of the business records you keep and for your own legal, tax and accounting obligations.
9. Suspension and Termination
- You may cancel your subscription and delete your account at any time (see the Account & Data Deletion page).
- We may suspend or terminate accounts that breach this Agreement, fail to pay due fees, or endanger the security of the Service, with notice where reasonably possible.
- Upon termination your access ends; data is deleted or anonymized in line with our Privacy Policy and legal retention obligations.
10. Changes to the Agreement
We may update this Agreement from time to time. Material changes will be announced through the Service; continued use after the effective date constitutes acceptance.
11. Governing Law and Disputes
This Agreement is governed by the laws of the Republic of Türkiye. Antalya courts and enforcement offices have jurisdiction. Consumers may also apply to Consumer Arbitration Committees and Consumer Courts within statutory limits.
